Who we are
Nayak Studio ("Nayak Studio", "we", "us" or "our") is a wedding photography and cinematography studio founded by Ajay Kumar Nayak, operating from Markona, Balasore, Odisha, India, and serving couples across India.
This Privacy Policy applies to www.nayakstudio.com (the "Website") and to the photography and videography services we provide. We are the data fiduciary responsible for the personal data described here.
We handle personal data in line with the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000 together with the rules made under it.
Information we collect
Information you give us directly
When you submit the enquiry form on our Website, we ask for the following. Every field is provided voluntarily by you.
| What we collect | Why we need it |
|---|---|
| Name | To address you correctly when we respond |
| Email address | To send you our reply, packages and availability |
| Phone number | To call or message you about your enquiry |
| Photography budget range | To recommend a package that genuinely fits |
| Your message (optional) | To understand what you are looking for |
If you go on to book us, we will additionally collect the details needed to actually deliver the work: wedding and event dates, venue and location details, timings, contact details for your family or wedding planner, and billing information such as your address and, where applicable, GST details.
Photographs and video footage
Photographing your wedding necessarily means we record images and video of you, your family and your guests. These images are personal data, and we treat them with the same care as any other information you share with us.
Information collected automatically
We want to be precise here, because it is less than most websites collect:
- We do not use cookies on this Website.
- We do not run analytics. There is no Google Analytics, no advertising pixels, no visitor tracking, and no profiling of the people who browse our pages.
- Our web host records standard server logs, which may include your IP address, browser type and the pages you requested. These are used only to keep the site running and secure.
How we use your information
We use your personal data only for the purposes below:
- To respond to your enquiry and discuss dates, packages and pricing.
- To provide our services, including planning your shoot, coordinating with venues, capturing your event, and editing and delivering your photographs and films.
- To manage the commercial relationship, including contracts, invoices, payments and tax records.
- To stay in touch about your booking, such as confirming schedules or sharing delivery links.
- To showcase our work, subject to the specific consent rules in the next section.
- To meet legal obligations under Indian tax, accounting and other applicable law.
We do not send marketing newsletters or promotional bulk messages to people who enquire, and we never sell, rent or trade your personal data to anyone.
Your photographs and our portfolio
Showing real work is how a wedding studio earns the trust of the next couple. So that this never comes as a surprise, here is exactly how it works.
Nayak Studio retains copyright in all photographs and films we create, as set out in our Terms of Service. Where you have agreed to it in your booking contract, we may display selected images from your event in our portfolio, on this Website, on our social media channels, in printed samples and albums, and in entries to photography competitions or publications.
You can opt out, at any time
Your consent to portfolio use is entirely yours to give and yours to withdraw:
- You may tell us before the event that you do not want any of your images published. We will honour that, and it will not affect your pricing or the service you receive.
- You may ask us at any time afterwards to take specific images down, or to stop using your images altogether. Write to us and we will remove them from our own channels within a reasonable period.
Once an image has been printed in a physical album or shared onward by third parties, we cannot always recall every copy, but we will always stop our own further use and remove it from every channel we control.
Guests at your event
Wedding photography inevitably captures guests. If a guest asks us to remove their image from our public channels, we will do so on request. Please do let your guests know that the event is being professionally photographed.
Sensitive moments
Some ceremonies and moments are private by custom or by choice. Tell us in advance and we will exclude them from anything published.
When we share information
We share personal data only where it is necessary, and only with parties who are bound to protect it:
- Our team and associate photographers working on your event, who receive only what they need to do their job.
- Album designers, printers and lab partners who produce your physical albums and prints.
- Technology providers that host our website, store our files and deliver your galleries.
- Professional advisers such as our accountants, and payment processors handling your transaction.
- Authorities, where disclosure is required by law, court order, or to establish or defend a legal claim.
Third-party services loaded on this Website
To keep the Website fast, we load fonts, icons and scripts from established content delivery networks, including Google Fonts, jsDelivr, unpkg, cdnjs and the Tailwind CSS CDN. When your browser fetches those files, those providers receive your IP address and basic browser information. We do not control what they do with it, and we receive nothing back from them.
Links to WhatsApp, Instagram, Facebook and Google Maps take you to services run by other companies. Once you follow such a link, their privacy policies govern, not ours.
Storage, security and retention
Enquiries submitted through the Website are stored in our database on our web host's servers. Photographs and films are stored on our working drives, on backup drives, and with the cloud storage providers we use to deliver galleries to you.
We protect your information with access controls on our systems, password-protected accounts limited to authorised team members, encrypted connections for the Website, and backup copies of your images held while your project is active.
No method of transmission or storage is completely secure. We work hard to protect your data, but we cannot guarantee absolute security, and we ask you to keep any gallery links or passwords we send you private.
How long we keep things
- Enquiries that do not become bookings are kept while we may still reasonably follow up, and are then deleted.
- Booking and client records are kept for the duration of the engagement and afterwards for as long as tax and accounting law requires.
- Photographs and films are archived for the period stated in your booking contract. After that period we are not obliged to keep copies, so please download and back up your delivered files promptly.
Your rights
Under Indian data protection law you have the following rights over your personal data:
- Access: ask us for a summary of the personal data we hold about you and how we process it.
- Correction: ask us to correct anything inaccurate, or complete anything incomplete.
- Erasure: ask us to delete your personal data where we no longer need it for the purpose it was collected and no law requires us to keep it.
- Withdraw consent: withdraw consent you have given, including consent to publish your photographs, at any time.
- Grievance redressal: raise a complaint with us about how we have handled your data.
- Nominate: nominate another person to exercise these rights on your behalf in the event of your death or incapacity.
To exercise any of these, email us at nayakstudio77@gmail.com. We will respond as promptly as we reasonably can, and normally within thirty days. We may need to verify your identity first, so that we do not disclose your information to someone else.
Withdrawing consent does not affect anything we did lawfully before you withdrew it, and it may mean we can no longer provide part of a service you have asked for.
Children's information
Our Website and services are not directed at children, and we do not knowingly collect personal data from a child through the enquiry form.
Children are of course present and photographed at weddings. We do not use images in which a child is the main subject for portfolio or marketing purposes without the consent of that child's parent or guardian. If you would prefer that images of your children are never published, tell us and we will mark your project accordingly.
If you believe a child has provided us with personal data through the Website, please contact us and we will delete it.
Changes to this policy
We may update this Privacy Policy as our services, our tools or the law change. When we do, we will revise the "Last updated" date at the top of this page.
If a change materially affects how we use your personal data, we will take reasonable steps to notify you directly, for example by email to clients with an active booking. Please review this page from time to time.
Contact us
For any question, request or complaint about this Privacy Policy or about how we handle your personal data, reach out to us directly. Ajay Kumar Nayak is responsible for privacy matters at Nayak Studio.
If you are not satisfied with our response, you may escalate your complaint to the Data Protection Board of India under the Digital Personal Data Protection Act, 2023.
